Re: Meeting with Mullendore on Summary Dismissal

Paul Yacisin and I met with VPSA R. Mullendore today to discuss the summary dismissal policy and other student judiciary issues.  The following was covered:

1.  RM has, as you already know, formed a special committee to evaluate judicial programs.  RM has only given the committee general guidelines, and he is going to allow the committee some latitude in deciding other issues.  He has made some recommendations:
a.  RM feels that the summary dismissal policy must remain in place.  However, the policy should have increased due process and a guarantee of a timely off-campus hearing.
b.  RM wants the judicial process to be streamlined with faster adjudication.
c.  RM wants students to represent themselves at their hearings, if this is legally possible.
d.  The tentative date for the first meeting is 10/15.  
e.  James Chin, an attorney is chairing the committee. (This is a poor policy decision.  It ensures that we will have a conservative, risk-averse outcome.)
f.  IFC has not chosen their representative yet.
g.  Judicial programs should be a learning process for all involved.
h.  The judicial panel should have a faculty/student mix.

2.  Senator Yacisin asked RM for his position and current status on any efforts to improve legal rights education of students.  
a.  RM said that James Chin is available for outreach and education.  Groups may ask Mr. Chin to do legal education functions.

3.  Tom Cochran & bad faith.
a.  RM said that he has found Tom Cochran open, candid, professional and open to change.  He suggests that Paul and I develop specific allegations, if  they exist, and speak with Mr. Cochran directly about whatever problems we may have.    

4.  I irritated RM by asking him questions about the makeup of the committee.  Specifically, I pointed out that judicial programs always punishes black fraternities more harshly than white fraternities.
a.  RM and I discussed student leadership at the University.  He was visibly uncomfortable, saying that he does not like my negativity and that he thinks that I bring up history too much.  
b.  This is weird because I wasn’t being too aggressive with RM.
c.  I gave a limited apology and told him that I would think about his comments.
d.  Having thought about his comments, I have concluded that he is incorrect.



Recommendations:

We need to develop a SGA agenda with Senator Myers, and take a unified approach to the judicial programs committee.  

To facilitate this, Senator Yacisin is writing me a list of policy suggestions for Senator Myers to consider.
